:
(a) The Department wishes to engage an EAP provider (the 'Contractor') to deliver a national service to assist employees and their immediate family members (the 'Clients') deal with personal, family, work performance and personal quality of life issues.  The required services include, but are not limited to, the following:
(i) unlimited confidential counselling to Clients either face-to-face or via telephone, as appropriate, by suitably qualified staff and within agreed timeframes;
(ii) referral of Clients to other appropriate services and specialists, as appropriate;
(iii) mediation services on a fee-for-service basis;
(iv) advice and assistance to managers and human resource staff on topics such as leadership, troubled employees, effective communication, conflict resolution and work/life balance;
(v) quarterly reports to the Department on usage, trends, issues and Client satisfaction; and
(vi) promotional materials to market the EAP services to Clients.
(b) The initial term of the contract will involve a two-month transition in period (if required) from 1 May 2008, with the full range of services to be provided from 1 July 2008 to 30 June 2010.  There will also be two extension options of a further 1 year each.
(c) The services are to be available to Clients from the Department and from IP Australia, which currently employ approximately 2750 staff.
(d) Any number of Departmental portfolio bodies may avail themselves of the agreement resulting from this RFT at an additional cost.  In addition, any number of other Commonwealth departments or agencies may elect to enter into an individual agreement with the successful tenderer.  Consequently, the volume of services required under this RFT may vary from time to time if other portfolio bodies, departments or agencies elect to procure services from the successful tenderer.
(e) Notwithstanding the above, the Department does not guarantee or make any assurance that any services or any particular volume of services will be procured from the successful tenderer by any other portfolio body, department or agency.
(f) The Department’s requirements are set out in more detail in Schedule 1.
(g) Any contract entered into as a result of this RFT will be based on the Draft Form of Contract. However, the Department may vary the terms and conditions (see clause 26(a).

The conditions for participation are:
a)The tenderer and any subcontractors proposed in the tender must not be named as not complying with the Equal Employment Opportunity for Women in the Workplace Act 1999 (Cth)
b)The tenderer and any subcontractors proposed in the tender are not insolvent, bankrupt, in liquidation, or under administration or receivership.
