The Defence Marine Support Services (DMSS) Group established by Royal Australian Navy (RAN) is establishing the DMSS Maritime Assurance Program (DMAP) Panel to support the ongoing delivery of DMSS capability through the replacement and/or addition of In Port (INPT) and Out of Port (OOP) vessels and assets.

RAN is seeking comment from industry on certain exposure draft contractual documentation prior to the issue of a formal RFT to the open market (currently anticipated to occur October 2022).

The documents included in this exposure draft (the Exposure Draft Documents) includes:

- Conditions of Deed;

- Description of Services

Comments to the Exposure Draft Documents must be in the form of the Feedback Template (attached) and should be submitted to the Address for Lodgement, no later than 1630 hrs (AEDT) on 16 September 2022.

You are under no obligation to comment on the Exposure Draft Documents and any response that is provided is submitted on a voluntary basis. However, please note that the information being sought has been identified by Defence as important for planning purposes, and to inform Commonwealth decision making, in relation to the DMAP Panel and to inform the preparation of solicitation documentation. In seeking your response, the Commonwealth wishes to ensure that this planning and decision making occurs with the full benefit of information provided by your organisation.

Respondents to this notice should note that the Commonwealth may publish any clarification question made in relation to the Exposure Draft and the Commonwealth’s answer to the query on Austender, without disclosing the source of the query or revealing any commercial-in-confidence information.

The Exposure Draft Documents are in draft form and the Commonwealth may add to, vary, modify or amend the Exposure Draft Documents prior to the issue of a formal RFT. The proposed tender, including the nature of the planned procurement, is subject to change and may not proceed.  

Any work performed by industry in relation to the Exposure Draft Documents is at their own cost and expense.  This notice is not a procurement process and no short listing will occur based on industry responses. Providing a response does not of itself entitle, qualify or disqualify the respondent to be invited to participate in any future industry engagement activity or procurement process.

This notice has been issued as a precursor to a planned upcoming procurement process.  The notice is designed to provide advance notification and provide information to industry on the upcoming procurement process and facilitate full compliance by tenderers with the draft Conditions of Deed. This notice does not represent a guarantee of works in any format.
