The AFP is seeking responses from suitably qualified and experienced service providers for ongoing maintenance, repairs, upkeep, administration functions and any resulting project works covering Mechanical Services, Electrical Services, Fire Services and Emergency and Exit Lighting for all AFP premises in the ACT.

1.1.1         AFP will exclude a Tender from further consideration if it considers that the Tender does not meet the following Conditions for Participation:

(a)      the Tenderer exists as a legal entity at the Closing Time and Date (see clause 2.5);

(b)      compliance with the Fair Work Act 2009;

(c)      the Tenderer and any nominated subcontractors proposed in the Tender must not be named as not complying with the Equal Employment Opportunity for Women in the Workplace Act 1999 (Cth);

(d)      the Tenderer and any nominated subcontractors proposed in the Tender must not, at the time of the Tender, be listed as a designated entity by the Minister of Foreign Affairs by notice in the Gazette under Section 15 of the Charter of the United Nations Act 1945. A consolidated list of such persons, entities and associated assets is maintained by the Department of Foreign Affairs and Trade under the Charter of the United Nations (Dealing with Assets) Regulations 2008;

(e)      the Tenderer and any subcontractors proposed in the tender are not insolvent, bankrupt, in liquidation, or under administration or receivership;

(f)      the Tenderer and any subcontractors proposed in the tender must provide a declaration of compliance with the National Code of Practice for the Construction Industry and the Australian Government Implementation Guidelines;

(g)      the Tenderer must attend the industry briefing, however site visits run in conjunction with this briefing are not mandatory.

1.1.2         AFP will not enter into an Agreement with suppliers who have had a judicial decision against them (not including decisions under appeal) relating to employee entitlements and have not paid the claim. Tenderers are required to provide confirmation of this issue in Schedule 4 - Tenderers Details.
