This RFT seeks organisations with the capacity and capability to provide to Finance individual contractors with professional expertise in certain areas to augment Finance’s staff as required. Procurement of teams or numbers of experts, usually responsible for specific project or collective outcomes, is beyond the scope of this RFT and is subject to separate acquisition processes.

Finance requires organisations that have the capacity and capability to supply to Finance Contractor Personnel in the following fields:
  • accountants, auditors and economists;
  • corporate communications experts;
  • experts in the areas of real property and construction; and
  • Information and Communications Technology (ICT) services personnel.

The Conditions for Participation applicable to this RFT process are that the Tenderer:

(a) is a registered company or business entity;
(b) is financially viable;
(c) has not made any false declarations in respect of any current or past dealings with the Commonwealth, including in any tender process or in any contract for services;
(d) has had no significant deficiency in the performance of any substantive requirement or obligation under any prior contract with the Commonwealth which would materially adversely affect the Tenderer’s ability to deliver the Services as detailed in this RFT;
(e) has professional indemnity insurance of at least $5 million and public liability insurance of at least $5 million;
(f) for the provision of ICT personnel, the Tenderer is endorsed under the Australian Government Endorsed Supplier Arrangement (ESA); and
(g) makes a declaration as to the matters in paragraphs (a) – (f) above in the Tenderer’s Declaration in Schedule 3 (Tenderer’s Declaration).

“Financially viable” means a Tenderer that has not had any of the following events occur in respect of it:

(a) a meeting of creditors being called or held;
(b) the appointment of a liquidator, provisional liquidator or administrator;
(c) the appointment of a controller (as defined in section 9 of the Corporations Act 2001 (Cth)), or analogous person appointed, including in respect of any of its property;
(d) a failure to comply with a statutory demand in respect of the payment of any debt;
(e) an inability to pay debts as they fall due or otherwise becoming insolvent;
(f) becoming incapable of managing its own affairs for any reason;
(g) taking any step resulting in insolvency under administration (as defined in section 9 of the Corporations Act 2001 (Cth));
(h) any action being commenced to bankrupt or wind-up its affairs; or
(i) entering into a compromise or arrangement with, or assignment for the benefit of, any of its creditors, or any analogous event.

For those Tenderers tendering for ICT services, there is an additional financial viability assessment involved in the process of gaining endorsement under the Australian Government Endorsed Supplier Arrangement and with subsequent periodic assessments under that arrangement.

Where a Tenderer is rejected for failure to meet the Conditions for Participation, the Tenderer will be advised in writing.
