The Respondent:  

  1. must provide a return signed declaration (at Part C of this EOI); 
  2. must provide returned the response form (Part B of this EOI);  
  3. must exist as a legal entity as at the Closing Date; 
  4. must not have been precluded from tendering for Australian Government funded work; 
  5. must not be subject to a judicial decision against the Respondent relating to employee entitlements; 
  6. must not have any adverse judgments against it with respect to Work Health and Safety laws, is subject to an order from any Court or Tribunal decisions relating to a breach of workplace relations law, Work Health and Safety laws or workers’ compensation law with which the Respondent has not fully complied; 
  7. must not be listed as a designated entity by the Minister for Foreign Affairs by notice in the Gazette under section 15 of the Charter of the United Nations Act 1945 or who intend to engage subcontractors who are listed as a designated entity by the Minister for Foreign Affairs by notice in the Gazette under section 15 of the Charter of the United Nations Act 1945; 
  8. must require that any builder contracted to undertake any building work as part of the Response will be accredited under the Australian Government Building and Construction Work Health and Safety (WHS) Accreditation Scheme while carrying out any building work and be must be compliant with the Building Code 2016 and the National Construction Code;
  9. At the time of submitting a Response, the Respondent must include a statement confirming that the Respondent will not engage Illegal Workers; 
  10. At the time of submitting a Response, the Respondent must confirm it (or any of its proposed subcontractors) is not currently named as not complying with the Equal Employment Opportunity for Women in the Workplace Act 1999 or the Workplace Gender Equality Act 2012 (Cth).  

The Commonwealth may exclude a response from evaluation if it does not demonstrate compliance with the Terms and Conditions for participation.
