This RFT is for the provision of Tourism Australia’s Public Relations activities for the following markets:

 

United States of America (USA)

 

Canada

 

Brazil & other Latin America

 

China

 

Hong Kong

 

Japan

 

India

 

New Zealand (NZ)

 

South Korea

 

Singapore

 

Malaysia

 

United Kingdom (UK)

 

International Markets (Business Events (MICE) PR Services only)

Conditions for Participation are the minimum mandatory conditions that Tenderers must meet in order for their RFT response to be considered by Tourism Australia.

 

 

Tenderers must satisfy the following Conditions for Participation:

  • The Tenderer and any subcontractors proposed in the RFT must not be named as not complying with the Equal Employment Opportunity for Women in the Workplace Act 1999 (Cth).
  • The Tenderer and any subcontractors proposed in the RFT must not be named on the list of persons and entities designated as terrorist organisations under:

    • the consolidated list of individuals and groups maintained by the Department of Foreign Affairs and Trade to which the terrorist asset freezing regime applies (see Charter of the United Nations (Dealing with Assets) Regulations 2008); and/or

    the list of prescribed terrorist organisations in the Criminal Code Regulations 2002.
  • The Tenderer must not have had an adverse Court or Tribunal decision for a breach of workplace relations law, occupational health and safety law or workers' compensation law and the Tenderer has not fully complied, or is not fully complying, with any relevant order made in respect of such breach order.  For the purposes of this clause:

    • An 'adverse Court or Tribunal decision' includes any penalty or order of a Court or Tribunal with which the Tenderer has not complied or is not complying.  It does not extend to infringement notices issued by workplace inspectors or a provisional improvement notice issued by an occupational health and safety inspector.

    • A decision or order that the Tenderer has not fully complied with does not include those instances where a penalty or order has

      been imposed but the period for payment/compliance has not expired.

    A 'Court or Tribunal' includes all courts, tribunals and commissions etc, howsoever named that are empowered by law to adjudicate and issue binding decisions or orders in respect of workplace relations law, occupational health and safety law, or workers' compensation law.
  • The Tenderer must provide details of any National Tourism Office (“NTO”) to whom it provides PR Services to enable Tourism Australia to assess the impact this may have on its commercial activities, brand image, competitive advantage and potential risks of conflicts of interests arising. In the event that Tourism Australia considers the provision of services to itself and another NTO to affect its best interests or render a conflict of interest, the Tenderer shall be excluded from further consideration in the RFT process.
  • The Tenderer must provide details of any Australian State Tourism Office (“STO”) to whom it provides PR Services in market, to enable Tourism Australia to assess the impact this may have on its commercial activities, brand image, competitive advantage and potential risks of conflicts of interests arising. In the event that Tourism Australia considers the provision of services to itself and another STO to affect its best interests or render a conflict of interest, the Tenderer shall be excluded from further consideration in the RFT process.

The proposed contract term is for an initial period of 3 years, from 1 July 2015 to 30 June 2018.   The contract will provide an option to extend for a further two terms of 12 months each until 30 June 2019 and 2020 respectively.  There is no guarantee that Tourism Australia will elect to exercise these options and the decision to do so shall be based upon the best interests and needs of Tourism Australia at that time.
