The purpose of this RFA is to identify an Insurance Provider to develop an affordable, commercial insurance solution for trade mark applicants and owners. IP Australia intends to work with the Insurance Provider selected to develop the Trade Mark Defence Insurance (TMDI) product. The successful Respondent will be granted, subject to legal restrictions, an exclusive listing and link on the IP Australia website and be mentioned in other relevant communication. The provider will be selected based on the detailed criteria set out in this Request for Application.

An Industry Briefing will be held on the 10th of May 2017 in Sydney at the AusIndustry NSW State Office, 341 George Street, Level 5 (entry off Wynyard Street) commencing at 10.00am. It is expected that the industry briefing will not last more than 90 minutes.

Attendance at the Industry Briefing is recommended but is not a requirement or a prerequisite to lodging an Application.

Applicants must be: 

(a) authorised to conduct insurance business in Australia pursuant to the Insurance Act 1973;

(b) an insurance broker that holds a valid Australian Financial Services license that permits it to advise, deal and issue general insurance products to both retail and wholesale clients; or  

(c ) an underwriting agency operating under a binder issued by an entity authorised to conduct insurance business in Australia pursuant to the Insurance Act 1973

For the avoidance of doubt, IP Australia will not consider applicants that rely on unauthorised foreign insurers to provide the underlying insurance coverage.

From the date of execution of the Deed of Agreement for two years, plus an option to extend for up to two further one year terms at the sole discretion of IP Australia.  Indicative timeframe for the execution of the Deed is July 2017.
