a. the Tenderer, and any party proposed by the Tenderer to provide any of the
Services, must not at the time of Tender be named as non-compliant with the
Equal Opportunity for Women in the Workplace Act 1999
(Cth) unless it has
obtained a letter of compliance from the Equal Opportunity for Women in the
Workplace Agency to be eligible for Commonwealth business and this letter is
included with the Tender or prior to the date by which offers are accepted;
b. the Tenderer, and any party proposed by the Tenderer to provide any of the
Services, must not have declared in its Tenderer's Declaration that it has an
unsettled judgement or judicial decision against it (not including a decision(s)
under appeal) relating to employee entitlements where the Tenderer, or any part
proposed by the Tenderer to provide the Services, has not paid the claim;
c. the Tenderer exists as a legal entity at the Closing Time (see clause 2.9); and
d. compliance with
the Fair Work Act 2009.
