CSIRO, through this Request for Tender (RFT), is seeking responses from suitably qualified and experienced service providers for the provision of Design Services (Design Services Contractor) for the Australian Centre for Disease Preparedness (ACDP) (formerly Animal Health Laboratory (AAHL)) Part Life (APL) refit project for project planning through to delivery of project outcomes.

Virtual Industry Briefing will be conducted in accordance with following clauses detailed below and in the Head Document Clause 5.10.

5.10 Industry Briefing
5.10.1 An Industry Briefing will be held (Via Webex) 11:00 AM on 28th July 2020 (Victoria, Australia Local Time). Attendance at the Industry Briefing is recommended, however is NOT a mandatory requirement for this RFT. Copies of any presentations and responses to questions provided at the Industry Briefing will be provided to Tenderers following the completion of the Industry Briefing. Individual Industry Briefings will not be provided.
5.10.2 Tenderers should indicate if they intend to attend the Industry Briefing by providing written details of the name, company and position of each person attending and an email address for notification of the WebEx meeting details to the CSIRO Contact Officer by close of business on 27 July 2020. Attendees who have not been notified to the CSIRO Contact Officer by this time may be refused entry to the Industry Briefing.
5.10.3 An Industry Briefing is conducted for the purpose of providing background information only. Tenderers should note the effect of the disclaimers and limitations of liability set out in this RFT. Tenderers should not rely on any statement made at the Industry Briefing as amending or adding to this RFT unless that amendment or addition is confirmed by CSIRO in writing.
5.10.4 CSIRO may conduct security vetting of persons wishing to attend the Industry Briefing.

5 Conditions of Tender
5.1 Conditions for Participation
5.1.1 Subject to clause 5.7, Unintentional Errors of Form, CSIRO will exclude a Tenderer from further consideration and evaluation if CSIRO considers in its absolute discretion that the conditions for participation set out in this clause have not been met by the Tenderer. Notwithstanding anything else contained in this Tender, only requirements listed in this clause will be deemed conditions for participation.
(a) the Tenderer exists as a legal entity at the Tender Closing Time and Date
(b) at the time of lodgement of their Tender, Tenderers must not have been:
i. precluded from tendering for Australian Government funded work or
ii. subject to a judicial decision against them relating to employee entitlements (not including decisions under appeal, and have not paid the claim
(c) In respect of Tenders valued over $4 million (GST inclusive), the Tenderer either:
iii. holds a Valid and Satisfactory Statement of Tax Record by the Tender Closing Time and Date; or
iv. has a receipt demonstrating that a Statement of Tax Record has been requested from the Australian Taxation Office by the Tender Closing Time and Date and holds a Valid and Satisfactory Statement of Tax Record no later than 4 business days from the Tender Closing Time and Date.
(d) This also applies to new businesses or foreign Tenderers that do not have an Australian tax record of at least four years. Further information can be found at clause 2.1.1 under Black Economy Procurement Connected Policy.
(e) In respect of Tenders valued over $4 million (GST inclusive), the Tenderer holds a Valid and Satisfactory Statement of Tax Record for anyfirst-tier subcontractor that it proposes, as part of its response, to engage to deliver goods or services with an estimated value of over $4 million (GST inclusive).
5.1.2 Where applicable, Tenderers should apply for a Statement of Tax Record and should ensure that their subcontractors apply for a Statement of Tax Record within sufficient time to meet these conditions for participation. For further information on the application process can be found at clause 2.1.1 under Statement of Tax Record.
5.2 Minimum Content and Format Requirements
5.2.1 Subject to clause 5.7, Unintentional Errors of Form, CSIRO will exclude a Tenderer from further consideration if CSIRO considers in its absolute discretion that the Tenderer’s response does not meet the minimum content and format requirements listed in this clause. Notwithstanding anything else contained in this RFT, only requirements listed in this clause will be deemed minimum content and format requirements for the purposes of this Tender.
(a) The Tender must be lodged electronically via AusTender, the Australian Government Tendering System, in accordance with, clause 3.8, AusTender Terms and Conditions
(b) The Tenderer must complete and submit in their Response the:
i. Tenderer’s Deed
ii. As set out in Attachment C - TRS (Tender Response Schedules).
iii. In respect of Tenders valued over $4 million (GST Inclusive), Tenderers (including new businesses and foreign Tenderers) must include with their Response either: 
iv. a Valid and Satisfactory Statement of Tax Record, or
v. A receipt demonstrating that a Statement of Tax Record has been requested from the Australian Taxation Office (noting in accordance with clause 5.1.1.c.ii, a Valid and Satisfactory Statement of Tax Record is required to be submitted to CSIRO no later than 4 business days from the RFT Closing Time and Date.)
(c) Lodgement of a valid and satisfactory Statement of Tax Record after the Tender Closing Time and Date must be via the CSIRO Contact Officer as per clause 3.4.1 and no later than 4 business days of the Tender Closing Time and Date.
(d) Noting the requirement at clause 5.2.1 b, Tenderers should substantially complete all remaining schedules of Attachment C - TRS (Tender Response Schedules).
(e) The Tender, including all attachments and supporting material, must be written in English.
(f) Alternative solutions will only be considered where the Tenderer also provides in its Tender a response that conforms to the specified requirements of this RFT.
