The purpose of this EOI is to identify one or more Suppliers for the Goods and/or Services outlined in Attachment A – SOR (Statement of Requirements). Only shortlisted Respondents (if any) from this EOI process may be invited to participate in any subsequent Request for Tender process (RFT).

This EOI is part of a potential multi-stage procurement and is an invitation to express interest and shall not be construed, interpreted, or relied upon, whether expressly or impliedly, as an offer capable of acceptance by any professional, firm or organisation or as creating any form of contractual, quasi-contractual, restitutionary or other relationship.

Nothing in this EOI will be construed to create any binding contract (express or implied) between CSIRO and any Respondent.

Subject to clause 5.7 of the EOI Head Document, Unintentional Errors of Form, CSIRO will exclude a Respondent from further consideration and evaluation if CSIRO considers in its absolute discretion that the conditions for participation set out in this clause have not been met by the Respondent. Notwithstanding anything else contained in this EOI, only requirements listed in this clause will be deemed conditions for participation.

(a) the Respondent exists as a legal entity at the EOI Closing Time and Date

(b) at the time of lodgement of their Response, Respondents must not have been:
i. precluded from tendering for Australian Government funded work or
ii. subject to a judicial decision against them relating to employee entitlements (not including any decisions under appeal, and have not paid the claim).

(c) Where the Respondent is a Relevant Employer, the Respondent must be compliant with its obligations under the Workplace Gender Equality Act 2012 (Cth) (the WGE Act). Further information may be found at http://www.wgea.gov.au/.

(d) the Respondent is currently accredited or in the process of being accredited, under the Australian Government Building and Construction WHS Accreditation Scheme and

(e) the Respondent must comply with all Mandatory Requirements identified in the Attachment A - SOR (Statement of Requirements).
