Provision of Laboratory Gases and related Services
CSIRO through this RFT is seeking responses from suitably qualified and experienced service Supplier/s for the provision of Laboratory Gases and related services.
ATO Shutdown:
Tenderers should be aware that the Australian Taxation Office (ATO) and their systems will close for maintenance from 24 December 2021 to 7.00am AEDT Tuesday 4 January 2022.
i.Statement of Tax Record (STR) requests lodged between:
•20 to 23 December 2021 may not be processed before the systems shutdown; and
•24 December to 3 January 2022 will not be processed.
Subject to clause 5.7, Unintentional Errors of Form, CSIRO will exclude a Tenderer from further consideration and evaluation if CSIRO considers in its absolute discretion that the conditions for participation set out in this clause have not been met by the Tenderer. Notwithstanding anything else contained in this RFT, only requirements listed in this clause will be deemed conditions for participation.
a.the Tenderer exists as a legal entity at the RFT Closing Time and Date
b.at the time of lodgement of their Tender, Tenderers must not have been:
i.precluded from tendering for Australian Government funded work or
ii.subject to a judicial decision against them relating to employee entitlements (not including decisions under appeal, and have not paid the claim
c.Where the Tenderer is a Relevant Employer, the Tenderer must comply with its obligations under the Workplace Gender Equality Act 2012 (Cth) (the WGE Act). Further information may be found at http://www.wgea.gov.au/
d.the Tenderer must provide:
i.a Valid and Satisfactory Statement of Tax Record/s, or
ii.A receipt/s demonstrating that a Statement of Tax Record has been requested from the Australian Taxation Office.
Where a receipt/s has been included with their Response, Tenderers must submit to CSIRO a Valid and Satisfactory Statement of Tax Record, no later than 4 business days after the RFT Closing Time and Date, via the RFT email box.
Note: Tenderers are to note, this requirement also applies to all new businesses and foreign Tenderers that do not have an Australian tax record of at least four years.
NOTE: Tenderers are to inform themselves of the requirements relating to obtaining an STR including the different rules that apply based on the entity structure, noting that a Tenderer may be required to provide more than one Statement of Tax Record to satisfy the Procurement Connected Policy.
Tenderers should be mindful of applying for a Statement of Tax Record under the correct entity structure to avoid an incorrect Statement of Tax Record being obtained Further information and guidance have been provided in clause 5.8.
e.the Tenderer holds a Valid and Satisfactory Statement of Tax Record for any first tier subcontractor that it proposes, as part of its response, to engage to deliver goods or services with an estimated value of over $4 million (GST inclusive).
f.the Tenderer must comply with all Mandatory Requirements identified in the Attachment A - SOR (Statement of Requirements).
Tenderers, and where applicable their subcontractors, should apply for a Statement of Tax Record within sufficient time to meet these Conditions for Participation.
