DFAT is seeking to shortlist several suppliers through the EOI process that have the experience, capability, capacity, and resources to appropriately furnish the new Australian Embassy in Washington DC, currently scheduled for completion in Q3 2022. The EOI is the first stage of a two-stage tendering process. Shortlisted Respondents will be invited to respond to a Request for Tender (RFT) in the second stage of the tender process. The RFT will comprise multi-stage processes that may include workshops, briefings and other activities as required by DFAT. These processes will be specified in the documentation released through the RFT stage.The evaluation criteria to be used for the RFT will be provided at the time of release of the RFT together with the form of contract proposed for the subsequent contract. A failure to respond to this EOI will result in a potential supplier not being eligible to participate in any subsequent RFT process.

:

a. The Respondent is submitting a Response as a single legal entity and will contract as this single legal entity (if invited to subsequently contract following an RFT process).

b. The Respondent if applicable, including Respondent members (if appropriate) or any subcontractors or sub consultants proposed must not be named as not complying with the Workplace Gender Equality Act 2012 (Cth).

c. The Respondent if applicable, including Respondent members (if appropriate) or any subcontractors proposed comply with the relevant requirements of the Fair Work Act 2009 (Cth).

d. The Respondent, including any consortia members (if appropriate) or any proposed subcontractors or sub consultants, is not subject to an adverse Court or Tribunal decision (not including decisions under appeal) for a breach of workplace relations law, work health and safety law, or workers’ compensation law, or if the Respondent is subject, that the Respondent has fully complied, or is fully complying with the Court or Tribunal order.

e. The Respondent, including any consortia members (if appropriate) or any proposed subcontractors or sub consultants, must not be listed on the World Bank List or any similar List maintained by a development donor and are not the subject of an informal investigation or temporary suspension which could lead to the Respondent, any partners, joint venture or consortia members or any proposed subcontractors or sub-consultants becoming so listed. The Respondent must immediately notify DFAT if it or any consortia members, subcontractors or sub consultants becomes listed, investigated or suspended by the World Bank or any development donor prior to the award of contract.

f. For the purposes of the Workplace Gender Equality Act 2012 (Cth) (WGE Act) if applicable, the Respondent must identify whether it is a ‘relevant employer’ under WGE Act.
