This RFP is seeking proposals for a Property Council of Australia (PCA) Grade A office space and associated carparking and facilities for a thirty year initial term with two by five year options. The building in which the Respondent proposes that the Premises will be located, must be in the City of Sydney Local Government Area (LGA) that must be an existing building or a building currently under construction that is capable of being available and in a condition so that the Fitout Works may be commenced on or before 1 July 2024.

Subject to section 4.3 of the RFP, the Commonwealth will exclude a Respondent from further consideration if at any time before a contract is executed the Commonwealth considers that the Respondent does not comply with any one or more of the following conditions for participation: 

a. the Respondent must exist as a legal entity as at the Closing Time; 

b. the building in which the Respondent proposes that the Premises will be located, must be:

i. in the City of Sydney Local Government Area (LGA);

ii. an existing building or a building currently under construction; and

iii. capable of being available and in a condition so that the Fitout Works may be commenced on or before 1 July 2024;

c. the Respondent either:

i. holds a Valid and Satisfactory Statement of Tax Record by the Closing Time; or

ii. has a receipt demonstrating that a Statement of Tax Record has been requested from the Australian Taxation Office by the Closing Time, and holds a Valid and Satisfactory Statement of Tax Record no later than 4 business days from the Closing Time; and

d. the Respondent holds a Valid and Satisfactory Statement of Tax Record for any first tier subcontractor that it proposes, as part of its Response, to engage to deliver goods or services with an estimated value of over $4 million (GST inclusive).

The AFP will consider progressive lease start dates provided that all leases have commenced in time to allow transition to the new premises prior to April 2026.
