The Department is seeking the services of accredited laboratories to undertake verification testing of electrical and gas products to ensure compliance with the performance and labelling requirements set out in Greenhouse Energy Minimum Standards (GEMS) determinations. Verification testing must be conducted by accredited laboratories with specialist equipment and suitably experienced personnel. Testing is to be carried out in accordance with the relevant Australian/ New Zealand or international test standard. Verification testing may be required on any of the products listed in the Request for Tender.

1. The tenderer and any subcontractors proposed in the tender must not be named as not complying with the Workplace Gender Equality Act 2012 (Cth).


2. The tenderer confirms that in dealing with its employees and independent contractors, the tenderer has due regard to Commonwealth policies on the engagement of workers, comply with Commonwealth policies on the engagement of workers, including the Fair Work Act 2009 (Cth), the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009 (Cth) and obligations under relevant occupational health and safety laws.


3. The tenderer and any subcontractors proposed in the tender are not insolvent, bankrupt, in liquidation, or under administration or receivership.


4. The tenderer, and any party proposed by the Tenderer to provide any of the Services, must not at the time of tender be listed as terrorists under section 15 of the Charter of the United Nations Act 1945 (Cth). A consolidated list of such persons, entities and associated assets is maintained by the Department of Foreign Affairs and Trade under the Charter of the United Nations (Dealing with Assets) Regulations 2008 (Cth).


5. The tenderer must hold accreditation or demonstrate the capability to obtain accreditation to test one or more of the GEMS products listed at Attachment 11. The specific requirements are accreditation in accordance with ISO/IEC 17025:2017 (General requirements for the competence of testing and calibration laboratories).

The contract is expected to commence late May 2018 and conclude late May 2021. A one year extension option will be incorporated into the contract, to be exercised at the Department’s discretion.
